Please read these terms of service (“Terms”) carefully before using the web design and development services and WordPress maintenance services provided by Hana Digital (“Hana Digital,” “we,” “us,” or “our”). By using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

Web Design and Development Services

1.1 Scope of Services: Hana Digital provides web design and development services tailored to meet your specific requirements. The scope of work, project timeline, and deliverables will be outlined in a separate agreement.

1.2 Client Responsibilities: You agree to provide all necessary information, materials, and cooperation required for the successful completion of the project. Delays caused by the client may impact the project timeline.

1.3 Intellectual Property: Upon completion of the project and full payment, you will own the intellectual property rights to the design and development work. Until final payment is received, Hana Digital retains ownership of the work.

1.4 Revisions and Changes: Revisions and changes to the project scope may incur additional charges. Any changes must be agreed upon in writing by both parties.

WordPress Maintenance Services

2.1 Scope of Maintenance: Hana Digital’s WordPress maintenance services include updates, backups, security monitoring, and troubleshooting to ensure the continued functionality and security of your WordPress website.

2.2 Access and Credentials: You agree to provide necessary access credentials for your WordPress website. Hana Digital will take all reasonable precautions to keep login information secure.

2.3 Backup and Recovery: While Hana Digital performs regular backups, it is your responsibility to ensure that critical data is backed up independently. Hana Digital is not liable for any loss of data.

2.4 Security: Hana Digital implements security measures to protect your website, but cannot guarantee absolute security. It is recommended that you follow best practices for online security.

Payment and Fees

3.1 Payment Terms: Payment terms will be outlined in the project agreement. Failure to make timely payments may result in project delays or suspension of maintenance services.

3.2 Additional Charges: Additional services or revisions beyond the agreed scope may incur additional charges. Hana Digital will communicate these charges and obtain your approval before proceeding.

Termination of Services

4.1 Termination by Client: If you wish to terminate Hana Digital’s services, you must provide written notice. Any fees for work completed and expenses incurred up to the termination date will be billed.

4.2 Termination by Hana Digital: Hana Digital reserves the right to terminate services for non-payment, breach of contract, or other justifiable reasons. In such cases, fees for work completed and expenses incurred will be billed.

Confidentiality

Both parties agree to keep confidential all information shared during the course of the project or maintenance services.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan.
